Unhappy meal: McDonald's suit claims toddler ate used condom

It's a story that leaves a bad taste in your mouth: A Chicago mother filed a lawsuit on Wednesday against McDonald's, alleging that her toddler found and ate a used condom in a play area last year.

According to the complaint, 2-year-old Jacquel "picked up a used condom that was on the floor. Then, shortly thereafter coughed up a piece of the used condom."

Now the boy's mother, Anishi Spencer, wants the burger chain to cough up $50,000 plus in legal fees.

Jacquel, who is now 3, "has suffered severe and permanent injuries, both physical and psychological, as well as pain and discomfort," the suit said. "He will become liable for sums of money for continued medical care throughout his life." The complaint made the same statement about Jacquel's 4-year-old brother Jonathan, who also handled the condom.

The complaint named McDonald's Corporation and McDonald's Restaurants of Illinois, Inc. as defendants, saying they "failed and neglected" to keep the restaurant clean and safe.

Providing a safe, clean environment is a top priority for us. This restaurant is no exception," McDonald's USA director of operations Wanda Haltek said in a statement. "These are just allegations and we strongly caution anyone from jumping to conclusions without having the facts."

Haltek said the incident was still under investigation when the lawsuit was filed and that Spencer hadn't turned over the "alleged object" for McDonald's to examine.

"Because this is now a pending legal matter, it would be inappropriate to further comment or speculate, she said.

That's sick. I don't know who's fault it was, but you don't just leave a used condom somewhere that a kid can find it.

Yeah see I had no idea what a condom was at the age of 3, let alone at the age of like 10! So for him to has pyschological pain and discomfort doesn't seem logical to me. But yes that is disgusting. I feel like the ball pit at Mc Donald's is full of a ton of nasty stuff. EW!

This happened a year ago and the mother is just now filing a lawsuit? To me it sounds like the mother is short on money to pay bills and saw her chance with this sneaky plan. Also, didn't his mother every tell him not to put trash in his mouth? This would be the equivalent of trash. And why was her child unsupervised long enough to find a condom, show it to his brother, and then eat it? There is something missing from this whole occurrence. Additionally, where did the condom come from and how exactly did she know the condom was used if her son only coughed up a portion of it? Too many unanswered questions, it has to be fake. And if the condom was used, shame of whoever it was that did use it. Why in a McDonalds, really? How disgusting that he even got away with that and how horrible that he couldn't dispose of it at least! Then this would've never ever happened. But like I said...to many unanswered questions to be real.

I think that the mom probably made it a bigger deal then it was. Obsiously it is disgusting but the kid didnt't know what it was! She could have taken care of it without all of the drama. Ball pits are nasty but now its on a whole other level!

I dont think ill ever let my kids play in those ball pits haha. But i agree with Celeste the mom is just sue happy like everyone else right now.

i personally find it ridiculous that the mother is going for so much. Yes if that really happened i think she in entitled to some money.. but not to the point where her second child gets money too, they have to pay for physical and mental issues, and that they have to pay for his health care for years to come that's just way too far!
