A car driven by Joshua Smith was allegedly overtaking other cars at high speed moments before slamming into a tree killing his mother. His estimated speeds were between 120 and 140km/h. He has pleaded not guilty to culpable driving, dangerous driving causing death and reckless conduct.
Do you think he is guiltly? And if so what punishment do you think he should recieve?
I think he is guilty because he was the one driving the car and crashed it killing his mother. He should be put in jail for a small period of time, not too long because he did not intentionally crash the car, so it seems. However, he was driving really fast, so it would be fair to give him a big fine as well, maybe also take away his license and some traffic school, maybe.
If he would have been driving safely I would say he is not guilty. But considering he was driving recklessly and faster than he should have he should be punished. I feel he should be sentenced to some jail time because he did cause the death of another person whether he meant to or not.
120 km/h is about 75 mph and im sure that all of us that drive have reached that speed before. However weaving in and out of traffic is dangerous at any speed and shouldn't be done. I don't think he is guilty due to the fact that I'm sure he wasn't planning on killing his mother and depending on the speed limit on the area he wasn't being negligent if it was on a free way.
I think he is guilty because the accident and the death of his mother was preventable. It would have occurred if he had drove safely. He has risked the lives of other drivers on the road and eventually led to death of his mother due to his reckless driving. He should be held responsible for his wrongdoings.
